Terms and Conditions

These Terms and Conditions apply when you use The Sports Archives website or purchase one of our products. By placing an order, you agree to these terms.

Products

The Sports Archives creates made-to-order sports artwork and display pieces. Product photographs and digital mock-ups are representative of the finished product.

We make reasonable efforts to accurately show each product’s design, dimensions, materials and colours. Colours and appearance may vary slightly due to screen settings, printing processes, materials and normal production variations.

Unless expressly stated, The Sports Archives is not affiliated with, endorsed by or sponsored by any athlete, club, league, competition or governing body referenced in our artwork.

Orders and acceptance

When you place an order, you are making an offer to purchase the selected product.

An order is accepted when we confirm it and payment has been successfully processed. We may contact you if additional information or clarification is required.

We may decline or cancel an order before production where:

• A product or material is unavailable
• An incorrect price or product description was displayed
• We cannot verify or process payment
• Delivery is unavailable to the supplied address
• A custom request contains unlawful, offensive or potentially infringing material

If we cancel an order after payment, we will refund the amount paid.

Prices and payment

All prices are displayed in Australian dollars unless stated otherwise.

Any applicable taxes, delivery charges and other unavoidable fees will be displayed before the order is completed. Payment must be made using one of the payment methods available at checkout.

We may change our prices at any time, but a price change will not affect an order that has already been accepted.

Made-to-order production

Each Archive is made to order. Production begins after the order and payment are confirmed and, for applicable custom products, after the required details or design approval have been received.

Production timeframes are estimates and may vary during busy periods or because of material availability. Any estimated timeframe will be shown on our website or communicated to you.

Changes and cancellations

If you need to change or cancel an order, contact us immediately at hello@thesportsarchives.com.au.

Because products are made to order, we cannot guarantee that an order can be changed or cancelled after production has begun. This does not affect your rights under the Australian Consumer Law.

Custom orders

You are responsible for ensuring that all information supplied for a custom order is complete and correct, including names, dates, wording, colours and design instructions.

Where we provide a design proof, you are responsible for checking it carefully before approval. Production may begin once approval is received.

By supplying an image, logo, wording or other material, you confirm that you own it or have permission to use it for the requested purpose. You agree not to submit unlawful, offensive or infringing material.

We may refuse a custom request where we reasonably believe producing it could be unlawful, inappropriate or infringe another party’s rights.

Shipping and delivery

Orders are shipped to the delivery address provided at checkout. You are responsible for checking that this address is correct and complete.

Estimated production and delivery times are guides rather than guaranteed delivery dates. Delays may occur because of postal services, customs, severe weather, high order volumes or circumstances outside our reasonable control.

Tracking information will be provided where available.

If an order is returned because an incorrect address was supplied, delivery was refused or the parcel was not collected, the customer may be required to pay reasonable redelivery costs.

Please contact us if an order appears lost or has not arrived within a reasonable period so we can investigate with the delivery provider.

International orders

International orders may be subject to customs duties, import taxes, tariffs or handling charges imposed by the destination country.

Unless expressly collected at checkout, these charges are not included in the product or delivery price and are the customer’s responsibility. International orders may also experience customs delays outside our control.

Returns and consumer guarantees

Because each Archive is made to order, we do not accept returns or exchanges for change of mind.

If a product arrives damaged, faulty or incorrect, contact us as soon as possible at hello@thesportsarchives.com.au.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Depending on the circumstances, you may be entitled to a repair, replacement, refund or another remedy. Nothing in these terms limits your rights under the Australian Consumer Law.

Intellectual property

Unless otherwise stated, the original artwork, product layouts, website content, photographs, graphics, branding and designs created by The Sports Archives remain the property of The Sports Archives or their respective rights holders.

You may not reproduce, sell, distribute, modify or commercially use our original content or product designs without written permission.

Purchasing a product does not transfer ownership of any intellectual-property rights in its design.

Website information

We take reasonable care to keep our website accurate and available. However, we do not guarantee that the website will always be uninterrupted or free from errors.

We may correct genuine errors in product information, availability or pricing. If an error affects an order you have placed, we will contact you and provide an appropriate option, which may include cancelling the affected order and issuing a refund.

Liability

Nothing in these terms excludes or limits any right, guarantee, remedy or liability that cannot lawfully be excluded, including rights under the Australian Consumer Law.

To the extent permitted by law, The Sports Archives is not responsible for indirect or consequential loss that was not reasonably foreseeable or caused by our failure to comply with an applicable legal obligation.

Changes to these terms

We may update these Terms and Conditions from time to time. The terms applying to an order will be those available when the order was placed, unless a change is required by law.

Governing law

These terms are governed by the laws of New South Wales, Australia. Nothing in this section prevents a customer from exercising rights available under applicable consumer law.
